The Mykolaiv City Council failed to resolve the land issue, which Kim had taken under his personal control

Deputies of the Mykolaiv City Council did not support the decision to refuse to grant land to Kristmas LLC. This issue was previously taken under personal control by the head of the Mykolaiv Regional Military Administration, Vitalii Kim.
This became known during the session on 12 March, according to NikVesti.
The issue concerns an appeal by Kristmas LLC, which requested permission to develop technical documentation for land management for a 4-hectare plot of land at 2-B 8th Pozdovzhnia Street. The territory is located in the area of the tram depot on Budivelnykiv Street, where the company plans to build a market.
In February, at a meeting of the ecology commission, the head of the Mykolaiv Regional State Administration, Vitalii Kim, who is also a member of the Mykolaiv City Council, announced that he was personally overseeing the issue of refusing to develop technical documentation for Kristmas LLC. He emphasised at the time that the councillors' vote on this plot would be publicly evaluated from the point of view of the city's interests.
At today's session, the deputies were supposed to reject Kristmas LCC. This issue was included in a «package» vote along with more than a hundred other land decisions. However, the package failed to gain support — there were not enough votes.
Even after several attempts to vote on the package, it did not receive the necessary support. Twenty-four voted in favour, seven abstained, so the decision was not adopted.
After that, at the suggestion of City Council Deputy and Head of the Inhulskyi District Administration Hanna Remennikova, Mayor Oleksandr Sienkevych put to a vote the question of cancelling the decision to form a package of land issues.
This would have made it possible to put the issue related to the Kristmas company to a separate vote. However, the proposal did not receive the necessary number of votes: 25 deputies supported it, and three abstained.
As a result, all 116 land issues included in the package will have to be reconsidered at a session of the city council.
It should be noted that this land issue concerning Kristmas LLC is not being considered by Council members for the first time. Earlier, at a session, the city council tried to pass a decision to deny the company permission to develop documentation, but at that time it also failed to receive the necessary number of votes.
After that, the issue was returned to the relevant deputy commissions for consideration.
Earlier, Mykolaiv City Council deputy Yevhen Pavlovych from the Propozytsia faction stated that some of his colleagues were sabotaging the vote on refusing to allocate 4 hectares of tram depot land to the market to Kristmas LLC.
In turn, Mykolaiv Mayor Oleksandr Sienkevych stated the need to involve the National Anti-Corruption Bureau of Ukraine (NABU) in cases concerning the return of 4 hectares of land, currently used by Christmas LLC, to community ownership.
The history of the plot on 8th Longitudinal
Earlier, Mykolaiv Mayor Oleksandr Sienkevych criticised a private developer who has been using city land for over 10 years but has not transferred the share of property stipulated in the contract to the community. He called such behaviour «boorish» and urged deputies not to be «long-suffering» in their relations with business.
The land plot in question is located at 8th Longitudinal Street, 2-v, in the Inhulskyi district of Mykolaiv, at the intersection with Budivelnykiv Street, not far from the Epicentre shopping centre. Previously, it was the site of tram depot №2 of the municipal enterprise Mykolaivelektrotrans. In 2012, the city council transferred 4 hectares of land for permanent use to the municipal enterprise Miskrynekhospodarstvo with the right to conclude a superficies agreement with Kristmas LLC. Its estimated value is about 110 million hryvnias.
Under the terms of the agreement, the investor was to build shopping pavilions, a third of which were to become the property of the community. The investment agreement was for 10 years and was valid until March 2024.
Currently, the city council, through the Commercial Court of Mykolaiv Region, is demanding that Kristmas LLC pay the debt for the use of land in the period from 2020 to March 2024 (9.1 million hryvnias), as well as for the actual free use of the land after the expiration of the agreement (1.3 million hryvnias). In addition, the city council has filed a lawsuit to return the land plot with the demolition of buildings and cancellation of state registration of ownership rights to real estate objects.
