Entrepreneur fined ₴523 thousand for construction in the centre of Mykolaiv that damaged a historic building

An entrepreneur was fined more than half a million hryvnias for building a high-rise building in the centre of Mykolaiv, which caused damage to a neighbouring building, a local architectural monument.
This was reported by Olena Tuova, Head of the State Architectural and Construction Control Department of the Mykolaiv City Council, on the «March TV channel».
The building, which was damaged as a result of neighbouring construction, is located on Kropyvnytskoho Street (formerly Potemkinska Street, — note), between Soborna and Heroiv Riatuvalnykiv Streets (formerly Lyahina Street, — note).
The State Architectural and Construction Control Department found violations during the inspection and filed a lawsuit, said Tuova. The court held the developer liable for 523,000 hryvnias, she added.
«There were a lot of complaints. One person complained that his house was falling apart, that there was a crack. The commission recorded that there was indeed a destruction of the house. We appealed to the Ministry of Regional Development and Infrastructure, and they agreed to conduct an inspection. It found violations of state construction standards both on the part of the designer, who violated fire safety standards, and on the part of the builder, whose actions could have caused damage to the citizen's building. Both were brought to justice. So far, we have won all the courts, including the Court of Appeal, and have brought to justice a total of 523 thousand hryvnias. Everything is now with the State Enforcement Service. We also wrote to the Association of Architects with a request to revoke the designer's certificate,» says Olena Tuova.
Then the residents have to go to court on their own to get compensation from the developer, she explained.
«If they go to court, they will receive compensation. We do not deal with compensation. We only record the fact of violation of urban planning legislation. Recording this fact allows a person to go to court,» added Tuova.
The building on Potemkinska Street, which dates back to the second half of the 19th century, has the status of an architectural monument of local significance. The apartment owners say that the first signs of the building's destruction appeared with the start of construction back in 2020, when the outer supporting wall of the building was demolished.
A Housing and Construction Cooperative «Potemkinska, 61», headed by Petro Orliohlo, has been registered on the site where construction work is taking place since 2016. The housing cooperative is the developer of the future residential complex «Knyazhyi».
The construction contractor was LLC «Stroitel», owned by Anzhela and Oleksii Nykodymyrovych Orliohlo, and the developer of the new building project is LLC «Arkhiland», among the founders of which are Anastasia and Oleksii Oleksiiovych Orliohlo.
It is noted that according to the building permit issued by the Department of State Architectural and Construction Control of the Mykolaiv City Council, the condition for construction was that the buildings of the cultural heritage sites located nearby and their architectural elements of the facades should not be interfered with.
