Mykolaiv City Council voted en bloc on fifty land issues online and without discussion

On June 3, the deputies of the Mykolaiv City Council gathered for a plenary session and voted en bloc on 51 land-related issues.

The session was held online and lasted about 15 minutes, according to a correspondent of NikVesti.

At the beginning of the session, Mykolaiv Mayor Oleksandr Sienkevych addressed the 29 deputies present with a proposal to vote en bloc on a number of land-related issues that could not be approved at the previous session on May 29 due to the lack of a quorum. The mayor emphasized that all deputies had the opportunity to review the draft decisions and receive responses from city officials regarding those proposals.

«We had big discussions, as a result of which deputies began to switch off and our session ceased to be competent. As of today, we have 52 land issues pending. All of them have been approved by the land commission. I have a suggestion. All these issues could have been considered, looked at, and asked colleagues or the Department of Architecture for additional information during this time. My proposal is as follows: all these draft decisions have been approved by the land commission, reviewed, have been hanging for more than 10 working days, everyone could read and provide their suggestions, you have the opportunity to give some suggestions on individual draft decisions now. If not, I propose that all these draft decisions be combined and put to an en bloc vote,» said Oleksandr Sienkevych.

At the suggestion of deputy Yevhen Prudnyk (elected from the banned «OPFL»), the issue of the easement on Namyv beach was excluded from the voting, so 51 draft decisions were put to the vote, which the deputies voted for without discussion.

48 issues were on the main agenda, and three more were introduced at the previous plenary meeting of the council. These three draft decisions were published on the website less than 10 working days before the date of consideration at the meeting, and the commission considered and approved them on 28 May.

  1. The draft decision concerns the lease of a 713 square meters land plot at 15-B Tsentralnyi Avenue in Zavodskyi district of Mykolaiv (near the Vodoprovidna bus stop) to «ATERA Ltd» for a 20-year lease term to maintain an administrative building with built-in retail premises. The plot has a designated purpose «for the construction and maintenance of administrative buildings» and is already built up. The decision is based on the company's application, technical documentation and the conclusion of the Department of Architecture, and the tenant is obliged to enter into a lease agreement and comply with the requirements of the Land Code of Ukraine.
  2. The draft decision provides for permission to «NIKCONSULT» to enter into a 1-year personal fixed-term easement agreement for the placement of temporary structures on a plot on Odesa Highway near building 88 in Mykolaiv. The land plot has an area of 144 sq m, includes protection zones around utility networks, and the agreement is allowed to be renewed four more times without a new decision of the city council. At the same time, the Anti-Corruption Department of Mykolaiv City Council has previously warned that the granting of easements without a tender may be non-transparent and contain corruption risks
  3. The latest draft decision concerns granting «Faktotum-M» permission to arrange an entrance to its private plot through communal land at Laherne Pole. For this purpose, it is planned to register a paid right to use part of this plot — a so-called land easement. At the same time, the city council's lawyers warn that the company submitted the documents late, so the previous permit has already expired, and any attempt to extend it violates the law.

The en bloc vote on the 51-item land package was supported by 28 deputies of the Mykolaiv City Council, with one deputy abstaining.

Earlier it was reported that the Mykolaiv City Council for the second time «failed» to approve the construction of a beach on Namyva by entrepreneur Volodymyr Aleksieiev, who is a freelance adviser to Vitalii Kim, the head of the Mykolaiv Regional Military Administration.
