Mykolaiv deputies failed to pass a package vote on 116 land issues

Deputies of the Mykolaiv City Council were unable to support a «package» vote on 116 land issues during the session.
During the session, Mayor Oleksandr Sienkevych proposed combining some of the land issues into a single package and voting on them simultaneously. After the list of issues was announced, the deputies supported the formation of the package.
Among them was the issue of refusing to grant Kristmas LLC permission to develop technical documentation on land management for the placement of a market. This concerns a 4-hectare plot of land at 2-B 8th Pozdovzhnia Street, near the tram depot on Budivelnykiv Street. The company is requesting that this territory be allocated for the construction of a market.
Despite support for the idea of forming a package, the necessary number of votes was not obtained during the vote on its adoption. Of the 35 deputies who were present in the session hall and joined online, only 26 took part in the vote.
«This is not normal. Colleagues, please join the vote,» the mayor appealed to the deputies.
However, after a second vote, the situation remained unchanged — only 26 deputies took part in the vote again. During the third attempt at voting, 31 deputies joined, but 24 voted «for» and 7 abstained, so the decision was not adopted.
The mayor suggested that some of the deputies were deliberately not participating in the vote.
«The entire package of decisions is being rejected and postponed to the next session,» concluded Oleksandr Sienkevych.
After that, city council deputy and head of the Inhulskyi district administration Hanna Remennikova proposed to remove the issue related to the company «Kristmas» from the package and put the rest of the land decisions to a vote again.
«I believe that this is preventing us from voting because there is an issue related to Christmas. We have already discussed this repeatedly at all sessions. Let's put it to a separate vote and vote on the package without it. And as for Christmas, we will understand the position of the сouncillors,» she said.
However, this proposal was not supported either. Twenty-five deputies voted to cancel the package, and three abstained, which was also insufficient to pass the decision.
As a result, all 116 land issues will have to be reconsidered at the next session of the city council.
We would like to remind you that at the session in December last year, deputies tried to vote to refuse permission to develop documentation for Christmas LLC, but the decision did not pass and was returned to the committees for consideration. It is also being considered on the basis of a court decision.
In February, members of the city council's standing committee on ecology and natural resource use supported the refusal of Christmas LLC to grant permission to develop technical documentation for the land under the market. However, they managed to do this on their second attempt after an appeal by the head of the Mykolaiv Regional State Administration, Vitalii Kim.
Earlier , Mykolaiv City Council deputy Yevhen Pavlovych from the Propozytsia faction stated that some of his colleagues were sabotaging the vote on refusing to allocate 4 hectares of tram depot land to Christmas LLC for the market.
In turn, Mykolaiv Mayor Oleksandr Sienkevych stated the need to involve the National Anti-Corruption Bureau of Ukraine (NABU) in cases concerning the return of 4 hectares of land, currently used by Christmas LLC, to community ownership.
The history of the plot on 8th Longitudinal
Earlier, Mykolaiv Mayor Oleksandr Sienkevych criticised a private developer who has been using city land for over 10 years but has not transferred the share of property stipulated in the contract to the community. He called such behaviour "boorish" and urged deputies not to be "long-suffering" in their relations with business.
The land plot in question is located at 8th Longitudinal Street, 2-v, in the Inhulskyi district of Mykolaiv, at the intersection with Budivelnykiv Street, not far from the Epicentre shopping centre. Previously, it was the site of tram depot No. 2 of the municipal enterprise Mykolaivelektrotrans. In 2012, the city council transferred 4 hectares of land for permanent use to the municipal enterprise «Miskrynekhospodarstvo» with the right to conclude a superficies agreement with Kristmas LLC. Its estimated value is about 110 million hryvnias.
Under the terms of the agreement, the investor was to build shopping pavilions, a third of which were to become the property of the community. The investment agreement was for 10 years and was valid until March 2024.
Currently, the city council, through the Commercial Court of Mykolaiv Region, is demanding that Christmas LLC pay the debt for the use of land in the period from 2020 to March 2024 (9.1 million hryvnias), as well as for the actual free use of the land after the expiration of the agreement (1.3 million hryvnias). In addition, the city council has filed a lawsuit to return the land plot with the demolition of buildings and cancellation of state registration of ownership rights to real estate objects.
