Court orders owner to rebuild historic «Dacha Kudryavtsev» in Mykolaiv, now a restaurant with a swimming pool

The court ordered the company «Restro Club» to restore the destroyed historic building of the «Dacha Kudryavtseva» complex, where a new restaurant with a swimming pool was opened last year, at its own expense.

This was reported to «NikVesti » by the Mykolaiv District Prosecutor's Office.

As you know, the prosecutor's office filed a lawsuit to oblige the owner to restore the historic building of the complex «Dacha Kudryavtseva», which was illegally demolished after an enemy shelling of the building.

«The Mykolaiv District Administrative Court agreed with the prosecutor's arguments that such actions by the owner of the monument grossly violated the rights of citizens to a proper cultural environment, as well as the requirements of Articles 24 and 27 of the Law of Ukraine «On the Protection of Cultural Heritage», the prosecutor's office explained.

They also added that after the decision enters into force, the prosecutor's office will ensure supervision over compliance with its implementation.

As you know, one of the six buildings of «Kudryavtsev's Dacha», located at 13 Sportyvna Street in Mykolaiv, was damaged after a Russian shelling in August 2022. A year ago, it became known that the owner of the territory dismantled the building. Later, the Department of Culture of the Mykolaiv Regional State Administration told «NikVesti » that they had not granted permission to dismantle the building.

As reported by the police, the Mykolaiv District Police Department has launched a pre-trial investigation into the illegal dismantling of a part of the historical monument. The case was opened under Part 2 of Article 298 of the Criminal Code of Ukraine (Illegal search operations at an archaeological heritage site, destruction, destruction or damage to cultural heritage sites).

In the summer of 2024, a recreational complex with a swimming pool and a restaurant, «Family Club», was opened on the site of the historic building.

«Kudriavtsev's Dacha» is an architectural monument of local significance, it was registered with the state in 1997 according to the order of Mykolaiv Regional State Administration. The monument is included in the State Register of Immovable Monuments of Ukraine. This complex was built in the 19th century as a family estate of a wealthy landowner and philanthropist Dmitry Rostislavovich Kudryavtsev, but after the revolution, it was used as a sanatorium for employees of the 61 Communards Shipyard (now the Mykolaiv Shipyard).

In 2021, deputies of the Mykolaiv City Council leased the territory of «Kudryavtsev's Dacha» to the company «Restro Club», founded by the husband and son of the head of the «Proposal» faction in the Mykolaiv City Council, the head of the administration of the city's Ingul district, Anna Remennikova, Valentyn and Boris Berestnev. Their families are also known to own the restaurants «Daily» and «Daily Sport» in Mykolaiv.

In the same year, the tenant began restoring the abandoned buildings, but the Department of Cultural Heritage Protection of Mykolaiv City Council reported that the historic complex was being reconstructed without the appropriate approval.
