Prosecutor's Office announces new suspicion to former Mykolaiv Regional State Administration official, suspended for negligence

Law enforcement officers have served a new suspicion on Oleksandr Nefyodov, former deputy director of the Department of Urban Development and head of the Capital Construction Department of the Mykolaiv Regional State Administration, who was convicted of negligence in the construction of a bridge across the Southern Bug River.

This was reported by PN with reference to the Mykolaiv Regional Prosecutor's Office.

It should be noted that in May, the official was convicted in this case. Oleksandr Nefiodov was sentenced to five years in prison, but with a two-year probationary period.

The new suspicion also relates to the work on the crossing between the villages of Bohdanivka and Kostiantynivka near Pivdenoukrainsk. As a reminder, the construction was carried out in the summer of 2021, and the total value of the contract was over 25 million hryvnias. According to the investigation, the officials assisted the contractor in seizing 1.6 million hryvnias. The actions are classified under Part 5 of Article 191 of the Criminal Code of Ukraine (complicity in the misappropriation of property through abuse of office).

According to the public procurement system Prozorro, the contract was concluded between the Department of Urban Development, Architecture, Capital Construction and Support of Development Projects of Mykolaiv Regional State Administration and Kyiv-based LLC «Transstroikapital». LLC «Kronos USC» also applied to participate in the tender. The works included arrangement of approaches and subgrade, reinforcement of slopes with gravel-mastic mixture, pavement arrangement, installation of bridge spans and structures, roadway pavement, sidewalks, railings, as well as installation of road signs and barrier fencing.

According to Opendatabot, the company «Transstroikapital» was established in May 2013, its director is Pavlo Samarets. This tender was the largest in terms of the amount among all the tenders in which the company participated. Previously, «Transstroikapital» participated in two procurements in Luhansk and Chernihiv regions, performing reconstruction and repair of hydraulic facilities and bridges.

The case concerning the contract between Mykolaiv UWA and LLC «Transstroicapital» is currently being considered by the Commercial Court of Mykolaiv Region at the request of the Prosecutor's Office. The parties entered into an agreement dated 26.07.2021 №32 and additional agreements №2 (29.12.2021), №3 (31.12.2022) and №4 (17.11.2023), which the prosecutor's office considers to violate the interests of the state.

The prosecutor's office is asking the court to declare these agreements invalid and to impose penalties on the contractor. According to the prosecution, the agreements were concluded in violation of the law, and the defendants failed to provide explanations and did not appear at the preparatory hearing. The court noted the need to provide the parties with additional time to submit evidence and explanations, and the preparatory hearing was adjourned to 2 October 2025.
