The Mykolaiv Alumina Plant is seeking to recover ₴10.2 million from its fund due to the unfinished construction of a sports ground

The Mykolaiv Alumina Plant wishes to terminate the donation agreement with the «Centre for Social Programmes» charitable foundation and reclaim 10.2 million hryvnias, which were earmarked for the construction of a sports ground in the Korabelnyi district.

The case is being heard by the Commercial Court, according to NikVesti.

It is worth noting that the «Centre for Social Programmes» charitable foundation was registered on 10 November 2004. Its director is Olena Ozhma. The foundation’s main activity is the provision of other social assistance without accommodation. According to OpenDataBot, the Mykolaiv Alumina Plant was the founder of the foundation and was part of the RUSAL group of companies. The foundation is currently under the management of the State Property Fund of Ukraine (SPFU).

The agreement was signed on 20 October 2021. According to the case file, the plant transferred 10.3 million hryvnias to the foundation for the implementation of the project ‘Construction of a new sports ground on the territory of the Korabelnyi sports town near the Vodolii sports complex in Mykolaiv. The facility was planned to be transferred to the city’s municipal ownership by 1 June 2022. Of the total amount, only 60,000 hryvnias were spent.

At the same time, the fund’s 2021 report noted in the document’s footnotes that the project had been suspended.

«The MMBF «CSP» did not commence construction of the sports ground for almost four years, and with the outbreak of the war, it took no action whatsoever aimed at implementing the project. Consequently, in breach of clauses 2.1, 2.2, 3.4 and 3.5 of the agreement, the defendant failed to fulfil the terms of the agreement regarding the use of the donation in the amount of 10,249,976.60 hryvnias for the purposes envisaged and agreed by the parties to the agreement,» the case materials state.

Under this agreement, the administration of the Korabelnyi District and the Department of Physical Culture and Sport were also involved in the cooperation.

During the preparatory hearing on 20 January, the court established that the donation agreement, attached to the case file, was drawn up in Russian. The Ministry of Health was ordered to submit a notarised translation of the documents into Ukrainian. The next hearing in the case is scheduled for April 2026.

NikVesti reported that in 2012, the Mykolaiv «Centre for Social Programmes» was recognised as one of the best regional charitable foundations in Ukraine.
