Mykolaiv City Council proposes to exempt some tenants from paying for communal property during the war

The Mykolaiv City Council has prepared a draft decision that provides for the exemption of some tenants from paying rent for communal premises during martial law.

The document is published on the city council's website and will be considered at a session scheduled for 30 October, according to NikVesti.

According to the updated terms, from 1 September 2022, tenants who are

  • were called up or accepted for military service after 24 February 2022 — for the period of service and another three months after its completion;

  • cannot use the property if it was seized in accordance with the legislation on the transfer of property under martial law;

  • provided rented premises for the arrangement of simple shelters or for the activities of volunteer, charitable and public organisations that help the military or the population;

  • do not use the premises due to their damage as a result of hostilities — for a period of up to six months after the date of damage;

  • have facilities in the territories where hostilities are or have been conducted, or in the temporarily occupied territories — for the duration of hostilities or occupation and for another three months after their completion.

In order to be exempted from payment, tenants must submit a written or electronic notice to the landlord with supporting documents.

In addition, all other tenants (except for those who pay a symbolic 1 hryvnia per year) will be charged 50% of the rent for the period of martial law and for three months after its cancellation.

As a reminder, Mykolaiv has reduced the rental rate from 3% to 1% for municipal land for developers and entrepreneurs affected by the war.
