The Mykolaiv court invalidated the contract for ₴38.8 million for the reconstruction of the main water pipeline

The Commercial Court satisfied the claim of the Mykolaiv Regional Prosecutor's Office and declared the subcontract for the reconstruction of the main water pipeline invalid.

This is stated in the court decision, adopted on October 30.

It should be noted that the cost of the works in the contract concluded last year in November between the Department of Urban Planning and Capital Construction and Mykolaivmiskbud LLC amounted to 38.8 million hryvnias. It provided for the reconstruction of a 600 mm water line along Flotska Street from Sheptytskoho Street to the «Pivnichnyi» NSW at the address: 3/1 Architektora Starova Street.

The recipient of donations is the NGO “Mykolaiv Media Hub” (EDRPOU 45160758). The work was supposed to be completed in December 2024, but in June the agreement was terminated by consent of the page without payment of funds.

As stated in the case file, violations were found in the contract, which became the basis for declaring it invalid.

The court also decided to collect court fees in the amount of 1,211.2 hryvnias for the benefit of the Mykolaiv Regional Prosecutor's Office from each of the parties: both from the Department of the Mykolaiv Regional Prosecutor's Office and from Mykolaivmiskbud LLC.

We remind you that this tender for the reconstruction of the specified area is one of 12 contracts concluded in 2023. The total amount of all was 1.3 billion hryvnias, as Nikcenter wrote about in August. Contractors should replace old pipes with a diameter of 600-1000 mm with polyethylene ones.

LLC «Mykolaivmiskbud» (355 million hryvnias), LLC «Odesaspecenergo» (242 million hryvnias) and LLC «Gazvodmontazh» (240 million hryvnias) were selected as contractors.

In October 2023, the publication «Our Money» analyzed the purchases of the Department of Town Planning, Architecture, Capital Construction and Development Project Support of the Mykolaiv Regional Military Administration for the reconstruction of the water main in Mykolaiv with a total cost of 836 million hryvnias, and stated that the prices were inflated by 2-3 times.

At the same time, the head of the Mykolayiv OVA Vitaly Kim, reacting to the mentioned publication, said that he would account for every penny spent, and urged «not to believe bad news.» He said this in his video message, which he published on the Telegram channel.
